Benjamin \u547d\u4ee4\uff0c\u5141\u8a31\u907a\u7522\u7ba1\u7406\u4eba\u57fa\u65bc\u5408\u7406\u63a8\u6e2c\uff08\u4f8b\u5982\u8a72\u540d\u5931\u8e64\u53d7\u76ca\u4eba\u5df2\u7d93\u53bb\u4e16\uff09\u4f86\u9032\u884c\u907a\u7522\u5206\u914d\u3002\u6700\u8fd1\u7684 <a href=\"https:\/\/www.hklii.hk\/en\/cases\/hkcfi\/2024\/2686?hl=HCMP%201750%2F2024%20\">HCMP 1750\/2024 \u9ec3\u9023\u767c<\/a> <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u6848\uff0c\u6b63\u597d\u5c55\u793a\u9999\u6e2f\u6cd5\u9662\u5728\u9019\u985e\u60c5\u6cc1\u4e0b\u5982\u4f55\u61c9\u7528 Benjamin \u547d\u4ee4\u3002<\/p>\n<h5>\u4ec0\u9ebc\u662f Benjamin \u547d\u4ee4\uff1f<\/h5>\n<p>Benjamin \u547d\u4ee4 \u662f\u6cd5\u9662\u6388\u6b0a\u7684\u4e00\u7a2e\u547d\u4ee4\uff0c\u5047\u8a2d\u67d0\u4e9b\u4e8b\u4ef6\u5df2\u7d93\u6216\u672a\u66fe\u767c\u751f\u7684\u60c5\u6cc1\u4e0b\u5206\u914d\u907a\u7522\uff0c\u4f8b\u5982\u5047\u8a2d\u5931\u8e64\u7684\u53d7\u76ca\u4eba\u5df2\u7d93\u53bb\u4e16\u3002\u9019\u7a2e\u547d\u4ee4\u6e90\u81ea\u82f1\u570b\u7684 Re Benjamin [1902] \u6848\uff0c\u7576\u6642\u6cd5\u9662\u5141\u8a31\u5728\u627e\u4e0d\u5230\u67d0\u4f4d\u53d7\u76ca\u4eba\u7684\u60c5\u6cc1\u4e0b\uff0c\u6309\u7167\u4ed6\u5df2\u53bb\u4e16\u7684\u5047\u8a2d\u4f86\u5206\u914d\u907a\u7522\u3002<\/p>\n<p>\u4e0d\u904e\uff0cBenjamin \u547d\u4ee4\u4e26\u4e0d\u6703\u5b8c\u5168\u525d\u596a\u5931\u8e64\u53d7\u76ca\u4eba\u7684\u6b0a\u5229\u3002\u5982\u679c\u8a72\u53d7\u76ca\u4eba\u65e5\u5f8c\u73fe\u8eab\uff0c\u4ed6\u4ecd\u7136\u53ef\u4ee5\u63d0\u51fa\u7d22\u511f\u3002\u4e0d\u904e\uff0c\u6b64\u547d\u4ee4\u80fd\u5920\u4fdd\u969c\u907a\u56d1\u57f7\u884c\u4eba\u3001\u907a\u7522\u7ba1\u7406\u4eba\u6216\u53d7\u8a17\u4eba\uff0c\u4f7f\u4ed6\u5011\u5728\u5408\u7406\u5047\u8a2d\u4e0b\u9032\u884c\u907a\u7522\u5206\u914d\u6642\uff0c\u4e0d\u6703\u56e0\u70ba\u65e5\u5f8c\u53d7\u76ca\u4eba\u51fa\u73fe\u800c\u9700\u8981\u627f\u64d4\u6cd5\u5f8b\u8cac\u4efb\u3002<\/p>\n<p>\u9019\u985e\u547d\u4ee4\u9069\u7528\u65bc\u53d7\u76ca\u4eba\u5df2\u7d93\u5931\u8e64\u591a\u5e74\uff0c\u4e14\u7d93\u904e\u5404\u7a2e\u52aa\u529b\u4ecd\u7121\u6cd5\u627e\u5230\u5176\u4e0b\u843d\u7684\u60c5\u6cc1\u3002\u5b83\u78ba\u4fdd\u907a\u7522\u4e0d\u6703\u56e0\u7121\u6cd5\u78ba\u5b9a\u500b\u5225\u53d7\u76ca\u4eba\u7684\u60c5\u6cc1\u800c\u9577\u671f\u64f1\u7f6e\u3002\u7136\u800c\uff0c\u6cd5\u9662\u4e0d\u6703\u8f15\u6613\u6279\u51fa\u9019\u985e\u547d\u4ee4\uff0c\u7533\u8acb\u4eba\u5fc5\u9808\u8b49\u660e\u4ed6\u5011\u5df2\u7d93 \u76e1\u4e00\u5207\u5408\u7406\u52aa\u529b \u53bb\u5c0b\u627e\u5931\u8e64\u53d7\u76ca\u4eba\uff0c\u624d\u6709\u53ef\u80fd\u7372\u6279\u3002<\/p>\n<h5>HCMP 1750\/2024\uff1aBenjamin \u547d\u4ee4\u5728\u9999\u6e2f\u7684\u61c9\u7528<\/h5>\n<p>HCMP 1750\/2024 \u662f\u9999\u6e2f\u6cd5\u9662\u8655\u7406\u5931\u8e64\u53d7\u76ca\u4eba\u554f\u984c\u7684\u6700\u65b0\u6848\u4f8b\u4e4b\u4e00\u3002\u6848\u4ef6\u6d89\u53ca \u9ec3\u9023\u767c\uff0c\u4ed6\u65bc 1999 \u5e74 \u53bb\u4e16\uff0c\u5728\u907a\u56d1\u4e2d\u5b89\u6392\u4ed6\u7684 \u7b2c\u4e8c\u4efb\u59bb\u5b50\u6587\u7f8e\u91d1\uff08\u7c21\u7a31 MMK\uff09 \u4eab\u6709\u5176\u7269\u696d\u7684\u79df\u91d1\u6536\u5165\u76f4\u81f3\u7d42\u8001\u3002\u7136\u800c\uff0c\u81ea\u9ec3\u9023\u767c\u53bb\u4e16\u5f8c\uff0cMMK \u5c31\u6d88\u5931\u7121\u8e64\uff0c\u904e\u53bb 25 \u5e74 \u5167\u672a\u6709\u4eba\u80fd\u5920\u627e\u5230\u5979\u3002<\/p>\n<p>\u907a\u7522\u7684\u5169\u4f4d\u5171\u540c\u7ba1\u7406\u4eba\u70ba\u4e86\u5c0b\u627e MMK\uff0c\u9032\u884c\u5927\u898f\u6a21\u641c\u67e5\u3002\u4ed6\u5011\u67e5\u95b1\u9999\u6e2f\u548c\u82f1\u570b\u7684\u907a\u7522\u53ca\u6b7b\u4ea1\u7d00\u9304\uff0c \u65bc\u591a\u4efd\u5831\u7ae0\u520a\u767b\u5c0b\u4eba\u555f\u4e8b\uff0c\u751a\u81f3\u89aa\u81ea\u524d\u5f80\u5979\u6700\u5f8c\u5df2\u77e5\u7684\u502b\u6566\u4f4f\u5740\u67e5\u627e\u3002\u5118\u7ba1\u5982\u6b64\uff0c\u4ecd\u7136\u7121\u6cd5\u627e\u5230\u5979\u7684\u4efb\u4f55\u8e64\u8de1\uff0c\u4e5f\u6c92\u6709\u8b49\u64da\u986f\u793a\u5979\u4ecd\u7136\u5728\u4e16\u3002\u7531\u65bc MMK \u82e5\u4ecd\u7136\u5065\u5728\uff0c\u61c9\u5df2 82 \u6b72\uff0c\u4e14\u5728 25 \u5e74\u5167\u5f9e\u672a\u5c0d\u907a\u7522\u63d0\u51fa\u904e\u4efb\u4f55\u8981\u6c42\uff0c\u907a\u7522\u7ba1\u7406\u4eba\u6c7a\u5b9a\u5411\u6cd5\u9662\u7533\u8acb Benjamin \u547d\u4ee4\uff0c\u8acb\u6c42\u6cd5\u9662\u6279\u51c6\u5728\u5047\u8a2d MMK \u5df2\u53bb\u4e16\u4e14\u7121\u7e7c\u627f\u4eba\u7684\u60c5\u6cc1\u4e0b\uff0c\u5206\u914d\u907a\u7522\u3002<\/p>\n<p>\u6cd5\u9662\u5728\u5be9\u8996\u6240\u6709\u8b49\u64da\u5f8c\uff0c\u6700\u7d42\u6279\u51fa Benjamin \u547d\u4ee4\uff0c\u5141\u8a31\u907a\u7522\u6309\u7167\u4e0a\u8ff0\u5047\u8a2d\u4f86\u5206\u914d\u3002\u6cd5\u9662\u8a8d\u70ba\uff0c\u7ba1\u7406\u4eba\u5df2\u7d93\u505a\u51fa\u8db3\u5920\u4e14\u5408\u7406\u7684\u52aa\u529b \u4f86\u5c0b\u627e MMK\uff0c\u800c\u5728\u9019\u7a2e\u60c5\u6cc1\u4e0b\uff0c\u63a8\u5b9a\u5979\u5df2\u53bb\u4e16\u662f\u5408\u60c5\u5408\u7406\u7684\u3002\u9019\u9805\u6c7a\u5b9a\u7d42\u65bc\u70ba 25 \u5e74\u7684\u4e0d\u78ba\u5b9a\u6027 \u5283\u4e0b\u53e5\u865f\uff0c\u8b93\u907a\u7522\u5f97\u4ee5\u6700\u7d42\u5206\u914d\u7d66\u5176\u4ed6\u53d7\u76ca\u4eba\u3002<\/p>\n<p>\u5176\u4ed6\u6848\u4f8b\u5982\u4f55\u63d0\u4f9b\u9032\u4e00\u6b65\u898b\u89e3\uff1f<\/p>\n<p>\u96d6\u7136 \u547d\u4ee4\uff0c\u4f46\u9019\u985e\u547d\u4ee4\u4e26\u975e\u81ea\u52d5\u7372\u6279\u3002\u5176\u4ed6\u6848\u4ef6\uff0c\u5982 <a href=\"https:\/\/www.hklii.hk\/en\/cases\/hkcfi\/2023\/199?hl=Lam%20Moon%20Wing%20%26%20others%20%5B2023%5D%20HKCFI%20199\"><em>HSBC Trustee (Hong Kong) Limited, the sole executor and trustee of the \u4e00\u6848\uff0c\u6cd5\u9662\u5f37\u8abf\u907a\u7522\u7ba1\u7406\u4eba\u9808\u5148\u76e1\u4e00\u5207\u5408\u7406\u52aa\u529b\u5c0b\u627e\u5931\u8e64\u53d7\u76ca\u4eba\u3002\u6cd5\u9662\u6307\u51fa\uff0c\u7533\u8acb\u4eba\u5fc5\u9808\u8b49\u660e\u5df2\u7d93\u7528\u76e1\u6240\u6709\u5408\u7406\u7684\u65b9\u6cd5\uff0c\u800c\u4e14\u6c92\u6709\u8b49\u64da\u986f\u793a\u9032\u4e00\u6b65\u641c\u5c0b\u6703\u6709\u7d50\u679c\u3002\u6b64\u5916\uff0c\u6cd5\u9662\u4ea6\u6307\u51fa \u5931\u8e64\u7684\u6642\u9593\u9577\u77ed \u662f\u95dc\u9375\u56e0\u7d20\uff0c\u7576\u53d7\u76ca\u4eba\u5931\u8e64\u591a\u5e74\uff0c\u6cd5\u9662\u6703\u8f03\u9858\u610f\u6279\u51fa Benjamin \u547d\u4ee4\u3002<\/p>\n<p>\u5728 HSBC Trustee (Hong Kong) Limited, the sole executor and trustee of the Deceased&#8217;s Estate v Lam Moon Wing &amp; others [2023] HKCFI 199\u4e00\u6848\uff0c\u6cd5\u9662\u5f37\u8abf\u5e73\u8861\u5931\u8e64\u53d7\u76ca\u4eba\u7684\u6b0a\u5229\u8207\u5176\u4ed6\u53d7\u76ca\u4eba\u7684\u5229\u76ca\u3002\u6cd5\u9662\u88c1\u5b9a\uff0c\u641c\u5c0b\u884c\u52d5\u61c9\u7b26\u5408\u6bd4\u4f8b\u539f\u5247\uff0c\u5373\u5982\u679c\u53d7\u76ca\u4eba\u5df2\u7d93\u5931\u8e64\u5e7e\u5341\u5e74\uff0c\u4e14\u9032\u4e00\u6b65\u641c\u5c0b\u7684\u6210\u529f\u6a5f\u6703\u6975\u4f4e\uff0c\u6cd5\u9662\u6216\u6703\u6279\u51fa Benjamin \u547d\u4ee4\uff0c\u8b93\u907a\u7522\u5f97\u4ee5\u59a5\u5584\u8655\u7406\u3002<\/p>\n<h5>\u7533\u8acb Benjamin \u547d\u4ee4\u7684\u5efa\u8b70<\/h5>\n<p>\u5c0d\u65bc\u907a\u7522\u7ba1\u7406\u4eba\u6216\u53d7\u8a17\u4eba\u4f86\u8aaa\uff0c\u5728\u7533\u8acb Benjamin \u547d\u4ee4 Benjamin \u547d\u4ee4\u53ef\u80fd\u662f\u6700\u6709\u6548\u53ca\u516c\u5e73\u7684\u89e3\u6c7a\u65b9\u6848\uff0c\u78ba\u4fdd\u907a\u7522\u53ef\u4ee5\u9806\u5229\u5206\u914d\u3002<\/p>\n<h5>\u7e3d\u7d50<\/h5>\n<p>Benjamin \u547d\u4ee4\u65bc\u907a\u7522\u7ba1\u7406\u4e2d\u767c\u63ee\u91cd\u8981\u4f5c\u7528\uff0c\u8b93\u907a\u7522\u7ba1\u7406\u4eba\u80fd\u5920\u5728\u53d7\u76ca\u4eba\u5931\u8e64\u7684\u60c5\u6cc1\u4e0b\uff0c\u900f\u904e\u5408\u7406\u5047\u8a2d\u4f86\u5206\u914d\u907a\u7522\u3002\u9ec3\u9023\u767c\u6848\uff08HCMP 1750\/2024\uff09 \u5c55\u793a\u4e86\u9999\u6e2f\u6cd5\u9662\u5982\u4f55\u61c9\u7528\u9019\u4e00\u539f\u5247\uff0c\u8b93\u907a\u7522\u4e0d\u6703\u88ab\u9577\u671f\u64f1\u7f6e\u3002\u8207\u6b64\u540c\u6642\uff0cYu Yee Luen\u6848 \u548c Lam Moon Wing \u6848\u4ea6\u8aaa\u660e\u6cd5\u9662\u5c0d\u641c\u5c0b\u884c\u52d5\u7684\u8981\u6c42\u53ca\u516c\u5e73\u8207\u5be6\u969b\u64cd\u4f5c\u7684\u5e73\u8861\u3002<\/p>\n<p>\u5c0d\u65bc\u907a\u7522\u7ba1\u7406\u4eba\u4f86\u8aaa\uff0c\u5168\u9762\u7684\u641c\u5c0b\u3001\u8a73\u7d30\u7684\u8a18\u9304\u53ca\u5c08\u696d\u6cd5\u5f8b\u610f\u898b \u662f\u6210\u529f\u7533\u8acb Benjamin \u547d\u4ee4\u7684\u95dc\u9375\u3002\u96d6\u7136\u6cd5\u9662\u4e0d\u6703\u8f15\u6613\u6279\u51fa\u9019\u9805\u547d\u4ee4\uff0c\u4f46\u53ea\u8981\u9075\u5b88\u65e2\u5b9a\u7684\u6cd5\u5f8b\u539f\u5247\uff0c\u907a\u7522\u7ba1\u7406\u4eba\u4fbf\u53ef\u5728\u78ba\u4fdd\u516c\u5e73\u7684\u540c\u6642\uff0c\u9806\u5229\u5b8c\u6210\u907a\u7522\u5206\u914d\u3002<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u9ad8\u8449\u5f8b\u5e2b\u884c\u7d93\u5e38\u8fa6\u7406\u6587\u4ef6\u516c\u8b49\u3002\u5982\u679c\u60a8\u9700\u8981\u9032\u4e00\u6b65\u77ad\u89e3\u8a72\u4e3b\u984c\uff0c\u6216\u60f3\u67e5\u8a62\u6587\u4ef6\u516c\u8b49\u4e8b\u5b9c\uff0c\u8acb<a
