Validity\uff09\u7684\u722d\u8b70\u3002\u6839\u64da\u300a\u907a\u56d1\u689d\u4f8b\u300b\uff08Wills Ordinance\uff09\uff08<a href=\"https:\/\/www.elegislation.gov.hk\/hk\/cap30\" target=\"_blank\" rel=\"noopener\">\u7b2c30\u7ae0<\/a>\uff09\u7b2c5\u689d\uff0c\u907a\u56d1\u5fc5\u9808\u7b26\u5408\u6cd5\u5b9a\u7684\u7c3d\u7f72\u53ca\u898b\u8b49\u7a0b\u5e8f\uff0c\u5426\u5247\u53ef\u80fd\u88ab\u8996\u70ba\u7121\u6548\u3002<\/p>\n<p>\u7b2c\u4e8c\u662f\u7acb\u907a\u56d1\u8005\u8a02\u7acb\u6709\u6548\u907a\u56d1\u7684\u80fd\u529b\uff08Testamentary Capacity\uff09\u7684\u554f\u984c\u3002\u6839\u64da\u666e\u901a\u6cd5\u4e2d\u7684\u8457\u540d\u6848\u4f8b Banks v Goodfellow\uff0c\u7acb\u907a\u56d1\u8005\u5728\u7acb\u907a\u56d1\u6642\u5fc5\u9808\u5177\u5099\u8a8d\u77e5\u80fd\u529b\uff08cognitive understanding\uff09\uff0c\u5373\u7406\u89e3\u5176\u884c\u70ba\u53ca\u5f8c\u7e8c\u5f71\u97ff\u7684\u80fd\u529b\u3002<\/p>\n<p>\u7b2c\u4e09\uff0c\u907a\u56d1\u4ea6\u53ef\u56e0\u7acb\u907a\u56d1\u8005\u5c0d\u5176\u5167\u5bb9\u662f\u5426\u771f\u6b63\u77e5\u60c5\u53ca\u540c\u610f\u907a\u56d1\u5167\u5bb9\u800c\u906d\u53d7\u6311\u6230\uff0c\u7576\u4e2d\u4ea6\u53ef\u80fd\u6d89\u53ca\u5176\u81ea\u7531\u610f\u5fd7\u662f\u5426\u53d7\u5230\u4e0d\u7576\u5f71\u97ff\uff08undue
