許多人在結婚時都會思前想後,也會選擇到海外結婚,但當婚姻有什麼「冬瓜豆腐」,最終不得不提出離婚,為了保障自身利益,原來選擇離婚地一樣重要。有律師指出,由於香港法律制度,在港離婚有不少「優勢」,本港已繼倫敦之後成為「離婚之都」。

2019年香港離婚率達48%,幾乎每兩對夫婦,就有一對離婚收場,據政府統計處公佈,1991年至2019年本港離婚宗數不斷增加,由1991年的6,295宗上升至2019的21,157宗。高葉律師行(Hugill & Ip Solicitors)創始人兼合夥人葉煥信(Alfred Ip)表示,除了本地夫婦在港離婚,還有不少外地夫婦選擇來港離婚,包括外國夫妻、中港夫妻,香港已繼倫敦之後成為了「離婚之都」。

港成「離婚之都」 擁不少優勢

葉煥信表示,不少人選擇來港離婚,是由於香港法制來自英國,行普通法制度,家事法庭有酌情管轄權,如何分配家產「無固定公式」計算,有較多「爭拗空間」,再者在港離婚時雙方資產透明度亦高於其他國家。

他續稱,其他國家或地區,未必可以輕易得知雙方資產細節,但香港的家事法庭,離婚程序中雙方有責任完整且詳細披露雙方名下財產,包括任何第三方代為保存的財產,「家產有幾多無所遁形,是否屬於雙方資產,亦成爭拗點。」

司法管轄權成關鍵

由於資產透明度高,香港被視為離婚首選地之一,但未必人人都能在港離婚。葉煥信稱,據香港《婚姻條例》,夫婦必須符合以下其中一個條件,才可經由香港法庭處理離婚申請。包括婚姻的任何一方是以香港為居籍;向法庭提出呈請或申請當日之前3年內,婚姻的任何一方慣常居於香港;向法庭提出呈請或申請當日,婚姻任何一方與香港有「密切聯繫」。

由此可見,即使夫婦二人並非於香港註冊,只要與香港有「密切聯繫」,亦可選擇在港離婚化,但何謂「密切聯繫」?葉煥信指出,不單只要在港有資產,即使其中一方擁有一間香港上市公司也不足以定義為「密切聯繫」,更要本人經常在港處理業務,甚至在港組織家庭,但都要視乎每個案件的實際情況。

惟跨境婚姻的話,至少涉及兩個不同地方的管轄權。以內地為例,內地以「大陸法」為主,財產分配有明文規定,假若財政更強的一方,搶先在內地申請離婚,是否又能「截糊」?葉煥信指出,「鬥快都冇用」,要視乎一籃子因素,例如香港是否有司法管轄權,是否適合處理該宗案件,再者考慮該宗婚姻是否應該終結,以至小朋友利益等。

有結婚無離婚?

如果雙方在香港結婚,又是否可以在港離婚?葉煥信指出,不是在某國結婚就代表該國家有司法管轄權處理離婚,「兩個人在香港結婚,但沒有以香港為居籍,且雙方不常居於港,可能就沒有辦法在香港離婚,假如二人本身亦沒有居住之地的戶籍,可能就沒有國家肯受理他們離婚」。

這引申到另一議題——同性婚姻。葉煥信認為,婚姻制度的目的是保障結婚雙方,尤其是依賴方能在離婚後受到保障,《婚姻法》根本概念是不要讓任何一方在離婚後失去保障,假如一對同性情侶在外國結婚,即使雙方均是香港人,但由於香港法庭不承認同性婚姻,這對同性情侶就不能在香港離婚,再加上沒有外國護照,或許無法在結婚之地離婚。

葉煥信感歎,如果說法律是保護弱者的,那麼承認同性婚姻,不是因為浪漫,不是為了追上時代需要,不是反歧視,而是令到任何人在任何情況下都能受到保障。

Synopsis in English

Choosing the right place to divorce is even more important than choosing the place to get married. Hong Kong, due to the advantages of its legal system, has become – together with London – the “Divorce Capital” with 21,157 cases filed in 2019.

Being a Common Law jurisdiction with a transparent court system, an obligation of full and frank disclosure of matrimonial assets, a straightforward application process where habitual residence or substantial connection to the territory must be proven, Hong Kong surely presents many advantages that lead couples to file for divorce in the territory.

Jurisdiction is key, especially when involving cross-border marriages – a common characteristic in Hong Kong given the strong links with Mainland China. There are many factors which need to be considered and the fact that a couple got married in Hong Kong doesn’t automatically mean that they can divorce in the territory – in extreme cases leaving spouses unable to file for divorce in any jurisdiction.

This leads to another issue: divorce in same-sex marriages. As same-sex marriage is not recognised in Hong Kong and many foreign jurisdictions might not allow divorce for non-residents or foreign passport holders, many LGBT couples might be left in a complex limbo without any chance to file for divorce. It is a typical issue where the law hasn’t caught up with times.
