Fiona Chan

Fiona specialises in dispute resolution acting for clients in a wide range of civil disputes. She also advises on contentious and non-contentious probate and family matters.

Fiona qualified in Hong Kong in 1992. Prior to joining Hugill & Ip, she led litigation teams in sizeable legal firms serving diverse clients – including HNWI, statutory bodies and public listed companies – and headed the probate and conveyancing department as a partner of a renowned local law firm.

She is experienced in a wide range of civil litigation including contractual and shareholders’ disputes, contentious probate and family disputes. She is also a Civil Celebrant of Marriages.

Apart from contentious matters, Fiona frequently acts for individual and professional clients in non-contentious probate matters such as estate administration for both Hong Kong and international clients and as professionally appointed estate administrator. She also advises on estate planning and mentally incapacitated persons enquiry proceedings.

Fiona has received the pro-bono award from The Hong Kong Law Society for her service to the community in multiple occasions. She was recognised by Private Client Global Elite and Doyle’s Guide for her Probate and Estates work.

She has contributed to The Hong Kong Encyclopaedia of Forms and Precedents (Family) published by LexisNexis.

During her spare time, Fiona enjoys scuba diving, skiing, travelling and horseback riding.

Fiona is fluent in Cantonese, Mandarin and English.

Civil Litigation

  • Chan Fok Yi, the executor of the estate of Chan Li Mui, deceased v. all occupiers of Lot No. 2 in Demarcation District 79, North New Territories and another – successfully claimed for adverse possession for the occupier (DCCJ 3157/2016)
  • Tam King Chi v Liu Chi Kin – successfully recovered money paid by inducement for the Plaintiff (HCA 1603/2006)
  • Shum Wai Wan v Kwong Fung Chu – successfully obtained mareva injunction against the defendant from dissipating assets and entered judgment against the defendant for breach of agreement for purchase of property (HCA 1917/1998)

Probate and Estate Management

  • Estates of Lai Suet Ching – acting for the caveator and successfully obtained a court order to pass over the children of the Deceased as administrator (HCCA1364/2015)
  • Estate of Shioo KC – acting for the Official Administrator in administering and collecting the estate
  • Estate of Luk YCP – administering the estate of the deceased as the Court Appointed Administrator
  • Estate of Ngan CW – acting for professional administrators in tracing assets of the Deceased and in conducting defence in proceedings against the estate

  • LWH v. YMY and others – acting for the executor in a claim under Inheritance (Provision for Family and Dependants) Ordinance (Cap. 481) against the estate (FCMP188/2017)
